工作职责

向法律助理四级汇报,担任新上诉部门九名司法上诉分析员之一。协助工业上诉法官,通过识别和检索在劳工与工业部(L&I)档案中发现的命令、信函和其他文件中的事实,以确定 BIIA 是否有管辖权来受理和审理案件。职责包括:

  • 接收并分析 incoming appeals,分配案号,并将案号及当事人信息录入数据库。
  • 通过从 ORION(L&I 的数据库)中检索信息,分析文件以确定其潜在法律影响,并从 ORION 中提取信息,确定哪些命令副本对法官在解决上诉时是必要的,从而建立上诉的管辖权历史。 
  • 审查和分析 L&I 档案中的 ORION 记录,确定是否应由委员会根据 RCW 51.52.060 接受或拒绝上诉;确定是否存在时效性或其他相关问题。
  • 撰写并校对命令,分析文件内容以确定其潜在法律影响,拒绝上诉供 BIIA 法官或助理首席法官审查/批准;撰写关于管辖权的命令、要求修正的命令以及根据记录授予救济的命令。  
  • 撰写备忘录(研究机构的重要决定及其他法院关于工伤赔偿法的决定)。
  • 将信息录入 BIIA 的案件管理系统。

资格要求

最低资格要求

选项 1:高中毕业或同等学历 在法律环境中支持律师、行政法官、工业保险上诉法官、审查法官或同等职位的四年工作经验。

选项 2:在华盛顿州政府担任法律助理二级(原法律秘书一级)一年。

选项 3:拥有法律秘书研究、法律助理研究或相关领域的两年学位 两年法律文书处理经验。

选项4:学士学位 两年法律文书处理经验。

可取的资格条件
  • 具有处理劳工与工业关系(L&I)索赔管理或工伤赔偿法的经验。

The BIIA is a medium-sized state agency under the administration of three full-time Board Members. It is independent from the Department of Labor and Industries (L&I). The BIIA hears appeals from decisions made by L&I in several areas. The three principal types of appeals are:
  • Industrial insurance (workers' compensation).
  • Safety citations under the Washington Industrial Safety and Health Act (WISHA).

Duties

Reporting to a Legal Assistant 4, serve as one of nine Judicial Appeals Analysts within the New Appeals unit.  Assist Industrial Appeals Judges by identifying and retrieving facts in orders, letters, and other documents found in the Department of Labor & Industries' (L&I) record to establish the BIIA's jurisdiction to grant and hear cases.  Duties include:

  • Receiving and analyzing incoming appeals, assigning docket numbers, and entering docketing and party information into a database.
  • Creating a jurisdictional history of the appeal by retrieving information from ORION (an L&I database), analyzing documents to determine their potential legal impact, and extracting information from ORION to determine which copies of orders are necessary for use by judges in resolving appeals. 
  • Reviewing and analyzing the L&I record in ORION and determining whether the appeal should be granted or denied by the Board pursuant to RCW 51.52.060; determining whether there are timeliness or other relevant issues.
  • Drafting and proofing Orders, analyzing the content of documents to determine their potential legal impact, denying appeal for the review/approval of a BIIA Judge or Assistant Chief Judge; drafting Orders Regarding Jurisdiction, Orders Directing Amendment, and Orders Granting Relief on the Record.  
  • Writing memoranda (researching agency significant decisions and other court decisions regarding workers' compensation law to do so).
  • Enters information into the BIIA's case management system.

Qualifications

MINIMUM QUALIFICATIONS

Option 1:  High school diploma or equivalent and four (4) years of experience in a legal environment in support of an attorney, administrative law judge(s), industrial insurance appeals judges(s), review judges(s), or equivalent.

Option 2:  One year as a Legal Assistant 2 (formerly Legal Secretary 1) in WA State Government.

Option 3:  A two-year degree in Legal Secretary Studies, Paralegal Studies, or related field and two (2) years of legal office experience.

Option 4:  A bachelor's degree and two (2) years of legal office experience.

DESIRABLE QUALIFICATIONS
  • Experience dealing with L&I claims management or workers' compensation law.
  • Experience using LIINIS and ORION.

  • Knowledge of the following:  workers' compensation, basic legal research; legal terminology; local, state, and federal court rules and their application; court procedures; legal forms and documents and their processing; sources for checking legal citations; proper citation of case law, regulations, and statutes; current legal office practices, methods and procedures; law office communications; correct punctuation, spelling, grammar, and vocabulary; database/index systems, and discovery procedures.
